Director ID deadline fast approaching

November 10, 2022BY Plastiras Lawyers

All existing company directors appointed on or before 31 October 2021 must apply for a Director Identification Number (DIN) by 30 November 2022 or risk serious penalties including imprisonment or substantial fines.  New directors must apply for a DIN before their appointment.

What are the consequences for not applying for a DIN in time?

The Australian Business Registry Services provides support and guidance to directors to assist them in understanding and meeting their director ID obligations. However, if you fail to complete the application in time, you risk facing serious criminal and/or civil penalties of up to $1.1million.

How to apply

You can apply for your DIN:

  1. online via the ABRS website;
  2. by phone; or
  3. with a paper form.

For more information on applying for your DIN, please refer to our earlier article https://plastiraslawyers.com/new-directors-identification-number-requirement-for-all-company-directors/

Can I apply for an extension?

If you are unable to apply for your director ID within the stipulated timeframe, you must complete an ‘Application for an extension of time to apply for a director ID’ form which can be found on the ABRS website here https://www.abrs.gov.au/sites/default/files/2021-10/Application_for_an_extension_of_time_to_apply_for_a_director_ID.pdf

You must provide a reason for your application for an extension of time. To reduce delays in processing an extension request, it is recommended that you provide supporting evidence and documentation with the application.  We can assist you with applying for an extension.
